Terms of Service

These Terms of Service ("Terms") govern your access to and use of Purpit ("Service"), operated by Jonathan-Silvester Stone (Einzelunternehmer), Schonensche Straße 13, 10439 Berlin, Germany ("we", "us", "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Purpit is currently in beta testing. This means: • The Service is provided for evaluation and feedback purposes • Features may change, break, or be removed without notice • The Service may be unavailable at times • We may discontinue the beta program at any time Your participation helps us improve Purpit. We appreciate your patience and feedback.

You must be: • At least 18 years old • Authorized to bind your organization (if signing up on behalf of a company) • Located in a jurisdiction where use of the Service is permitted

During the beta period: • Access is by invitation or waitlist approval only • You are responsible for maintaining the confidentiality of your login credentials • You must provide accurate information when registering • One account per person or organization

You agree not to: • Use the Service for any unlawful purpose • Attempt to gain unauthorized access to our systems • Interfere with or disrupt the Service • Reverse engineer, decompile, or disassemble any part of the Service • Share your beta access with unauthorized third parties • Use the Service to compete with Purpit

You retain ownership of any data you provide to the Service ("Your Data"). You grant us a limited license to use Your Data solely to: • Provide and improve the Service • Generate aggregated, anonymized insights We will handle Your Data in accordance with our Privacy Policy at https://purpit.ai/privacy.

Any feedback, suggestions, or ideas you provide about the Service ("Feedback") may be used by us without restriction or compensation to you. You grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate Feedback into our products and services.

The Service, including all content, features, and functionality, is owned by us and protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: • MERCHANTABILITY • FITNESS FOR A PARTICULAR PURPOSE • NON-INFRINGEMENT • ACCURACY OR RELIABILITY OF RESULTS We do not warrant that the Service will be uninterrupted, error-free, or secure.

TO THE FULLEST EXTENT PERMITTED BY LAW: • WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES • OUR TOTAL LIABILITY SHALL NOT EXCEED €100 OR THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, WHICHEVER IS GREATER This limitation applies regardless of the legal theory (contract, tort, or otherwise). Some jurisdictions do not allow limitation of liability for certain damages. In such cases, our liability is limited to the maximum extent permitted by law.

You agree to indemnify and hold us harmless from any claims, damages, or expenses (including reasonable legal fees) arising from: • Your use of the Service • Your violation of these Terms • Your violation of any third-party rights

These Terms remain in effect while you use the Service. Either party may terminate at any time: • You: by discontinuing use and requesting account deletion • Us: by providing notice via email Upon termination: • Your access to the Service will cease • We may delete Your Data after 30 days • Sections 6-11 and 14-15 survive termination

We may update these Terms at any time. Material changes will be communicated via email or website notice at least 14 days before taking effect. Continued use after changes constitutes acceptance of the new Terms.

These Terms are governed by the laws of Germany, excluding conflict of law rules. Any disputes shall be resolved in the courts of Berlin, Germany. If you are a consumer in the EU, you retain the benefit of mandatory consumer protection laws in your country of residence.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and us. Severability: If any provision is found unenforceable, the remaining provisions remain in effect. No Waiver: Our failure to enforce any right does not waive that right. Assignment: You may not assign these Terms. We may assign them to a successor or affiliate.
